General Provisions
These Terms and Conditions (“Terms”) form the basis of a fair and enduring business relationship between Bodega Casas de Eufemia SL, Avenida San Luis 95 – 0 G, 28033 Madrid (Madrid), Spain (“the Company”), and the customer (“Customer” or “You”). By placing an order, You acknowledge and accept these Terms. The Company is committed to providing high-quality service and customer satisfaction.

Scope of Application
These Terms govern all purchases and contractual relationships between the Company and the Customer. Any deviations from these Terms require written agreement. The product offering on eufemia.es is intended exclusively for customers within the delivery regions specified on the website. The Company does not deliver outside these regions unless expressly indicated. Certain products, particularly rare or limited-edition wines, may only be available in restricted quantities.

Conclusion of Contract
Upon submitting an order, You will receive an automatic email confirming receipt. This confirmation does not constitute acceptance of the order. A binding contract is established only when the Company expressly accepts the order, either through issuance of an invoice, written confirmation by email, or dispatch of the goods. The contract applies solely to the products listed in the corresponding invoice or order confirmation.

Protection of Minors
The Company does not sell alcoholic beverages to persons under the age of 18. By placing an order on eufemia.es, You confirm the accuracy of your information and your legal eligibility to purchase alcohol.

Product Availability
The product range, including vintages and specific items, may change without notice. Availability cannot be guaranteed at all times. The Company reserves the right to make short-term adjustments to available products and vintages based on inventory levels.

Prices
All prices are stated per bottle and include applicable VAT. Prices are non-binding until contract acceptance and may be adjusted at any time without prior notice. Sales are subject to availability, and prior sale remains expressly reserved.

Payment Terms
Accepted payment methods include major credit cards (VISA, Mastercard, AMEX), Maestro, UnionPay, Shop Pay, Apple Pay, Google Pay and invoice when offered on the website. Invoices must be paid within 10 days of issuance. For first-time customers, the Company reserves the right to request advance payment.

Inspection and Notification of Defects
The Customer must inspect the goods immediately upon receipt. Deliveries shall be deemed accepted if no written notice of defects is received within 8 days. Claims submitted after this period cannot be considered.

Warranty and Quality Issues
Cork-taint defects may be compensated up to a maximum of 10 percent of the purchased original bottles, provided the claim is made within 12 months of delivery. Wines not purchased from the Company are excluded from replacement or reimbursement. Vintages older than 9 years are sold strictly at the Customer’s own risk (“Buyer’s Risk”), and no warranty is provided for such products.

Transport Damage
In the event of transport-related damage, including loss or breakage, the Customer must report the issue directly to the responsible shipping company. The Company will support the Customer in facilitating the claim where possible.

Credit Assessment
By placing an order, the Customer authorizes the Company to obtain necessary information from public authorities or credit agencies to process the order. For credit assessment purposes, personal data may be transferred to relevant credit information service providers and may be stored by them.

Amendments to the Terms
The Company reserves the right to amend these Terms at any time without prior notice. The version applicable at the time of order placement shall govern the contractual relationship.

Governing Law and Jurisdiction
All contractual relationships shall be governed by the laws applicable at the Company’s registered office. The exclusive place of jurisdiction is the competent court at the Company’s domicile.
